How will I know if there is a trust?
What needs to be done?
What if there is a Mortgage?
What Are my ongoing duties?
The will of the person who has died creates the trust. You may see words like Property Protection Trust, Flexible Lifetime Interest Trust, Nil Rate Band Trust all of these would indicate that a trust exists and you as Executor/ Trustee need to take action. If in doubt seek advice, we are happy to offer a free interpretation of the terms of the Will if you are unsure.
A trust isn't fully constituted until the assets are in the hands of the Trustees, which is where we step in to help. We ensure that the trust is properly set up and registered with HMRC where appropriate.
Many people think that they don't have to take action, but you could be creating personal liability if you allow the trust to be unconstituted.
If there is outstanding lending on the property being transferred to trust, this adds an extra layer of complexity. Most lenders will not allow lending on trust property. If the estate cannot repay the outstanding lending then we have to reflect the trusts interest in the property with a restriction on the title. Don't worry though, our expert conveyancers will deal with everything for you.
Your responsibilities as a trustee don't end with setting up the trust, in fact it is just the beginning. Many trusts are quite passive, some require active management. Al will require you to hold a trustee meeting at least every year.
